Terms of Service

Last updated: 2026-08-14

These Terms of Service (“Terms”) govern your access to and use of the Velaro mobile applications and related services (the “Service”) operated by Istvor (“Velaro”, “we”, “us”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we process personal data.

1. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use the Service. By using Velaro you represent that you meet this requirement and have legal capacity to enter into these Terms.

2. The Service

Velaro is a social platform for motorcycle riders. Features may include, without limitation:

  • Account and profile (handle, bio, avatar, garage/bikes)
  • GPS ride recording and ride history
  • Social feed (posts, comments, respects)
  • Followers / following and trusted groups
  • Explore live location sharing (optional, session-based)
  • Media uploads (photos)

We may change, suspend, or discontinue features reasonably, including for maintenance, security, legal, or product reasons. We will try to avoid unnecessary disruption but do not guarantee uninterrupted or error-free availability.

3. Accounts and security

  • You must provide accurate registration information and keep credentials secure.
  • You are responsible for activity under your account.
  • Notify us promptly of unauthorised use: [email protected].
  • We may suspend or terminate accounts that violate these Terms or create risk to the Service or other users.
  • You may delete your account in the app (Settings → Delete account). Effects of deletion are described in the Privacy Policy (immediate invisibility; permanent purge within 30 days, subject to limited legal exceptions).

4. Acceptable use

You agree not to:

  1. Break applicable law or encourage illegal activity
  2. Harass, threaten, stalk, or abuse other users
  3. Post content that is hateful, pornographic involving minors, or otherwise unlawful (see Child safety standards)
  4. Impersonate others or misrepresent affiliation with Velaro
  5. Scrape, spider, or harvest data from the Service without our written permission
  6. Reverse engineer, interfere with, or overload the Service (except to the extent such restriction is prohibited by law)
  7. Upload malware or attempt unauthorised access to systems or other accounts
  8. Use the Service to track people without a lawful basis and their appropriate consent/knowledge where required
  9. Use live location or ride data in a way that endangers yourself or others
  10. Circumvent safety, privacy, or rate-limit controls

We may remove content and restrict accounts that violate this section.

Child safety standards

Velaro (operator: Istvor) has zero tolerance for child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM).

  • The Service is not directed at anyone under 16 (see §1).
  • You must not create, upload, store, distribute, or otherwise share CSAE/CSAM, including sexual content involving minors.
  • Report child-safety concerns to [email protected] (including via Settings → Terms in the app). When we obtain actual knowledge, we remove the content and/or the account.
  • We report confirmed CSAM to the relevant authorities, in Poland including the police and Dyżurnet.pl (NASK), and where applicable the National Center for Missing & Exploited Children (NCMEC).

This section is Velaro’s published child-safety standard as required by, among others, Google Play. It is not legal advice.

5. User content

5.1 Ownership

You retain ownership of content you create and upload (“User Content”), including photos, captions, ride metadata you author, and profile text.

5.2 Licence to Velaro

By submitting User Content, you grant Velaro a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and otherwise use that User Content solely to operate, improve, and promote the Service (including showing it to other users according to your visibility settings).

This licence ends when your User Content is deleted from our systems, except for reasonable residual copies in backups until rotated, and except for content shared or reshared by others where technically retained under their accounts as permitted by product design and law.

5.3 Your responsibility

You represent that you have all rights needed to grant the licence above and that your User Content does not infringe others’ rights (including privacy, publicity, and intellectual property).

5.4 Feedback

If you send ideas or feedback, you grant us a perpetual, royalty-free licence to use them without obligation to you.

6. Location and safety

Ride recording and Explore use device location services.

  • You control when recording or live sharing is active.
  • Live location is sensitive — share only with people you trust and settings you intend.
  • Velaro is not an emergency, navigation-assurance, or roadside-assistance service. Ride responsibly and obey traffic laws. You assume the risks of motorcycle riding and of sharing location data.

7. Third-party services

The Service relies on third parties (for example Firebase Authentication, Crashlytics, map SDKs, cloud hosting, and object storage). Their terms and privacy policies apply to their processing. We are not responsible for third-party services we do not control, except as required by mandatory law.

App Store / Google Play terms also apply to distribution of the apps.

8. Intellectual property (Velaro)

The Service, branding, software, and documentation (excluding User Content) are owned by Velaro or its licensors. These Terms do not transfer ownership to you. You receive a limited, revocable, non-transferable licence to use the apps for personal, non-commercial use in accordance with these Terms.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that GPS tracks, stats, maps, or live presence are accurate, complete, or suitable for any particular purpose.

Nothing in these Terms excludes liability that cannot be excluded under applicable consumer law (including in the EEA/UK).

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Velaro and its directors, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service.
  • Our aggregate liability arising out of these Terms or the Service is limited to the greater of (a) EUR 50 or (b) the amounts you paid us for the Service in the 12 months before the claim (currently typically EUR 0 if the Service is free).

These limits do not apply to liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited by law.

11. Indemnity

To the extent permitted by law, you will indemnify and hold Velaro harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate access if you breach these Terms, if required by law, or if needed to protect the Service or users. You may stop using the Service and delete your account at any time. Provisions that by nature should survive (including §§5, 8–11, 13–14) survive termination.

13. Changes to the Terms

We may update these Terms. We will change the “Last updated” date and, where required, provide additional notice. If you continue using the Service after changes take effect, you accept the updated Terms where permitted by law. If you do not agree, stop using the Service and delete your account.

14. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence continue to apply.

Courts of the competent courts of Poland shall have jurisdiction, unless mandatory law gives you the right to bring proceedings in your place of residence.

EU consumers may also use the European Online Dispute Resolution platform where available: https://ec.europa.eu/consumers/odr/

15. Miscellaneous

  • If a provision is unenforceable, the remainder stays in effect.
  • Failure to enforce a provision is not a waiver.
  • These Terms are the entire agreement regarding the Service (together with the Privacy Policy and any in-app notices that expressly form part of the contract).
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
